Senator Durbin to Introduce Bill
According to the article: "The bill would... require manufacturers to register dietary supplement products [with] the FDA, require labels to disclose the known risks of ingredients and display a mandatory warning if the product contains a dietary ingredient that may cause potentially serious adverse events. The bill also calls for labels to display the batch number, something already adopted as standard "
The article quotes leading dietary supplement lawyer Jonathan Emord, calling the bill a “classic example of regulatory overkill.... The FDA has full regulatory power to prevent the sale of adulterated and misbranded foods and dietary supplements... By introducing new powers when old ones are more than sufficient, [Durbin] invites abuses, including more burden and cost on an industry that is already overwhelmed by the burden and cost of the GMPs and, now, the [sic] Food Safety Modernization Act,” added
POWER IS THE GOAL: "Sen Durbin said that his goal “is to take the decision about how a product will be regulated out of the hands of the manufacturer and put it in the hands of the FDA where it belongs."

On June 9th the current White House occupant signed Executive Order #13575 to create what are called "Rural Councils" -- the Czars are coming to the farms and the current Administration continues with its program of seizing control of the "commanding heights" of the American economy. This Action item also opposes this Order. Executive Order #13575 creates a White House Rural Council. The new council consists of 25 Cabinet Secretaries, chaired by the Secretary of Agriculture.

What we have called Sen. Leahy's "Criminalization of Food and Speech" bill, which claims to "increase criminal penalties for certain knowing and intentional violations relating to food..." but applies only to SPEECH, has reared its ugly head again, as S.216. This Action Item opposes this bill.

Together, we sent over six million emails to them regarding the fake "food safety" (really "food control") bill S.510/HR.2751 which passed the Lame Duck Congress on December 21, 2010.

Barack Should Have Vetoed the Food Control Bill
The current White House occupant signed the bill into law 01.04.11.
While we ultimately may not have stopped this new law in the lame-duck Congress of 2010, the law that was adopted is a different creature than we would have faced had we not opposed it every step of the way. Recall, the first version of the bill that passed the House in July ‘09 had severe penalties and no significant exemption for local production and distribution. The version that passed the Senate at the end of November 2010 not only had no such severe penalties, but did have a rather weak exemption for some local production and distribution.
It also did not have, as it might have, without our Push Back, two draconian bills that had been introduced in the Senate to prepare the way to add their terms to the final “food safety” bill; these were Sen. McCain’s discredited S.3002 which would have brought Dietary Supplements under even greater Federal control and the “criminalization of speech about food claims” bill, S.3767, introduced by the majority party “leadership” late in the session. The criminal penalty bill, while remaining a future risk, went nowhere, after over a hundred thousand messages of opposition. Opposition to McCain’s attempt to legislate Codex compliance was so great that he withdrew his own support from his own bill a month and a day after introducing it in February 2010. And the final "FDA Food Safety Modernization Act" as adopted has a somewhat stronger local food exemption, with a limited inflation escalation clause, so the exemption may become somewhat meaningful, depending on how the final regulations are written.
This Action Item is to the White House & new Speaker of the House, the FDA oversight subcommittee Chairman, and your Member of Congress. It is the first step in educating decision makers regarding the new law and any regulations issued under it.
1. We want the White House to intervene in the FDA regulation-making process to make sure that certain concerns get addressed:
a. Implementing the exemption for local production and distribution in the least burdensome way.
b. Assuring that Section 104’s “in the interest of national security” clause is not used to create secret regulations favoring Big AgBiz, violating the promises of "transparency" and,
c. No “back-door” HARMonization of our food freedoms with international Codex Alimentarius restrictions!
2. We seek to prevent any funding for this increase in Federal power in the new Congress; this includes especially the budget-busting 4,000 new FDA food control inspectors: Speaker Boehner, Chairman Kingston, just say "NO!".
There is much to be concerned about in the bill as adopted by the Congress, including the potential for secret regulations in violation of due process that section 104 seems to allow, the convoluted procedure for local food production exemptions, and the "road map" the new law provides for rapid "HARMonization" of our food freedoms with international Codex restrictions...
