Ask the State of Hawai`i to uphold mitigations for Navy Exercises!
On May 23, 2008, Hawaii's Coastal Zone Management Program issued a list of limitations on U.S. naval exercises in and around the Hawaiian archipelago. The limitations were required in order to bring the Navy's proposed activities into compliance with Hawaii's coastal zone protections, which are authorized under the federal Coastal Zone Management Act.
The limitations relevant to high-intensity active sonar required:
1. In nearshore waters, high-intensity active sonar must not exceed 145 decibels because this is widely accepted (even by the Navy) to be a safe level for marine mammals and humans;
2. In all other situations, abide by the conditions imposed by Judge Erza in the Federal District Court.
On June 20, 2008, the Navy responded with a refusal to recognize Hawaii's authority to protect its coastal resources under the Coastal Zone Management Act.
