Thank You for Granting Clemency to John Eley

CLEMENCY GRANTED!

Please Thank Governor Kasich.

John Jeffrey Eley was scheduled to be executed July 26, 2012 for his role in the murder of Ahsan Aydah in 1986. In a 5 to 3 split decision issued on June 20, 2012, the Ohio Parole Board rejected clemency for Mr. Eley.

Prominent individuals connected to the case supported clemency for Mr. Eley because they no longer felt his case necessitated his execution. These individuals include:

  • Gary Van Brocklin, the prosecuting attorney who tried the case.
  • The Hon. Peter Economus, one of the three judges who sentenced Mr. Eley to death.
  • Retired detective Joseph Fajack, the lead investigator on the case who secured Mr. Eley’s confession.
  • Guy Trammel, a probation officer familiar with Mr. Eley who prepared the presentencing report.
On July 10, 2012, Governor John Kasich granted clemency and commuted Eley's sentence to life imprisonment without the possibility of parole.

Additional case information is here, in the Cleveland Plain Dealer's editiorial applauding this decision.

Please join the individuals above in thanking Ohio Governor Kasich for granting clemency to John Jeffrey Eley by signing this petition, which also calls on Governor Kasich to put a halt to future executions. Your signatures will be hand delivered to Governor Kasich at a strategic moment in the near future.

Dear Governor Kasich,

We thank you for sparing the life of John Eley by commuting his death sentence. The reasons for clemency were compelling: prominent individuals connected to the case voiced their support for clemency; there is evidence that Mr. Eley suffers from an intellectual disability; and had it not been for Melvin Green, this crime would have never been committed.

In agreeing with the minority recommendation of the Ohio Parole Board in this case, your decision to grant clemency to John Eley speaks to the thoughtful consideration you gave this case and your statesman-like leadership in doing what is right instead of what is easy. Thank you, Governor Kasich.

Many questions remain open regarding the fairness, accuracy and general appropriateness of death penalty practices in Ohio. The Ohio Supreme Court is currently engaged in a study of Ohio’s capital punishment system. Ohio Supreme Court Justice Paul Pfeifer, a primary author of Ohio’s death penalty statute when he was an Ohio legislator, has called for the repeal of the death penalty, and he is joined in that call by two former heads of the Ohio Department of Rehabilitation and Correction – Terry Collins and Reginald Wilkinson, among many other Ohioans.

Again, thank you for making the right decision for Mr. Eley. It would also be a correct decision to impose a moratorium on future executions pending the outcome of the Ohio Supreme Court study and the implementation of its recommendations. We urge you to impose a moratorium on executions immediately.

Thank you.
