24 states have rejected Real ID, either by passing legislation refusing to implement the federal program, or passing resolutions decrying the de facto national ID card. Real ID is dying, and Senator Daniel Akaka (D-HI) is attempting to revive it.

 

S. 1261, PASS ID Act, sponsored by Senator Akaka, is Real ID with a new name. While the act repeals Title II of the Real ID law, it replaces the section with essentially the same thing:

 
  • We will still have a national ID card, which would violate privacy by helping to consolidate data and facilitate tracking.
  • PASS ID mandates that all identity source documents be copied physically or digitally and retained as long as the license is valid. By creating troves of sensitive documents on millions of individuals, this provision will be a dream for identity thieves.
  • In a provision that is actually worse than Real ID, PASS ID will allow insecure technology such as radio RFID chips to be used as part of PASS ID, despite the strong potential that technology holds for tracking of individuals' movements.
  • We will need a PASS ID card to enter federal buildings or board planes.
  • These burdens threaten our First Amendment guarantees to freedom of assembly and freedom to petition one's government, as well as the constitutionally protected right to travel.
  • For certain religious minorities, the digital photograph requirement violates First Amendment-protected free exercise of religion.
 

Real ID is dying because it's an unworkable program.  Changing its name isn't going to solve the problems it's created.  Call Senator Collins before the Homeland Security Committee hearing on S. 1261 on July 15th (202-224-2523). Tell her PASS ID doesn't fool us. It's unworkable, unfunded, and violates our privacy and civil liberties. Encourage her to oppose S. 1261, Senator Akaka's PASS ID Act.
